What purchases of bicycles and electric motorcycles are permitted in Pillar 2?

What are the minimum and maximum amounts of the mobility budget?

The distance is measured in a straight line using Google Maps. 🔎 Mobiliteitsbudget en cafetariaplan: wat mag wel en wat niet?
Recent stelde Nahima Lanjri (cd&v) een parlementaire vraag over een opvallende praktijk: de combinatie van het mobiliteitsbudget met een cafetariaplan.
Waarom is dit relevant?
 Omdat sommige cumulaties niet stroken met de geest én de letter van de wet.
⚠️ Waar wringt het in de praktijk?
Situatie 1
Een werknemer ruilt zijn wagen in voor het mobiliteitsbudget.
 Hij kiest geen wagen in pijler 1 en besteedt alles in pijler 2 en 3.
Maar via het cafetariaplan kiest hij alsnog een (meer vervuilende) bedrijfswagen.
➡️ Volgens het officiële antwoord moet in dat geval het mobiliteitsbudget worden stopgezet vanaf de maand waarin de werknemer opnieuw over een wagen beschikt.
Situatie 2
Een werknemer kiest wél een milieuvriendelijke wagen in pijler 1.
Maar via het cafetariaplan financiert hij:

een upgrade van die wagen
of bijvoorbeeld een laadpaal

➡️ Ook dit is problematisch.
Waarom?
 Omdat het mobiliteitsbudget wettelijk strikt begrensd is (art. 12 W 17.03.2019).
Wanneer het budget ontoereikend is:

moet de werknemer het verschil terugbetalen
of moet het verschil als loon worden beschouwd en onderworpen worden aan RSZ en belastingen

De wet laat dus geen cumulatie toe waarbij men via een cafetariaplan dezelfde sociale en fiscale voordelen zou verkrijgen bovenop het mobiliteitsbudget.
Dat zou immers neerkomen op een bijkomend voordeel dat niet strookt met de principes van de wet.
📜 Wat zegt de overheid duidelijk?

Het mobiliteitsbudget heeft een specifieke sociaal- en fiscaalrechtelijke behandeling.
Bij overschrijding van de wettelijke grenzen verliest het die gunstregeling.
De combinatie met een cafetariaplan mag niet leiden tot een hogere totale kost dan waarop de werknemer recht heeft binnen de wettelijke vork.

🎯 Conclusie
Het mobiliteitsbudget is geen vrij combineerbaar voordeel.
 De grenzen zijn wettelijk bepaald en strikt.
Cumulatie met een cafetariaplan is enkel mogelijk zolang:
✔ de wettelijke maxima gerespecteerd blijven
 ✔ er geen bijkomend fiscaal gunstregime ontstaat
 ✔ de werknemer niet opnieuw over een bedrijfswagen beschikt buiten pijler 1
Anders vervalt het gunstregime.

Zoals zo vaak bij het mobiliteitsbudget geldt: de technische details maken het verschil.
